1. Acceptance

By creating an account, accessing, or using NeoGH ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms constitute a binding agreement between you and NeoGH.

2. Eligibility

NeoGH is available to individuals aged 15 and above. Users under the age of 18 must have parental or guardian consent. By creating an account, you represent that you meet these eligibility requirements. We reserve the right to verify age and request parental consent.

3. Account Registration and Security

You must provide accurate, current, and complete registration information
You are responsible for maintaining the confidentiality of your login credentials
You must notify us immediately of any unauthorised use of your account
You may not create multiple accounts or share your account with others
We reserve the right to refuse registration or suspend accounts at our discretion

4. User Conduct

You agree not to:

Submit false, misleading, or fraudulent information
Attempt to manipulate leaderboards, XP scores, badges, or any gamification system
Harass, abuse, defame, or harm other users
Attempt to breach platform security, including but not limited to: SQL injection, XSS, rate-limit bypass, or session hijacking
Access or attempt to access another user's data without authorisation
Use automated scripts, bots, or scrapers without prior written consent
Post or transmit any unlawful, harmful, or infringing content

5. Payments and Certificate Purchases

5.1 Payment Processing

Certificate purchases are processed by Flutterwave Inc., a PCI-DSS compliant payment processor. NeoGH does not store, process, or have access to your full payment card details. All transactions are governed by Flutterwave's terms and privacy policy.

5.2 Pricing

All prices are displayed in GBP (£) and converted to GHS at the point of payment. Prices are subject to change without prior notice, but the price at the time of purchase will apply.

5.3 Refund Policy

Digital certificates: Due to the digital nature of certificates, all sales are final once the certificate is issued and the verification code is generated. No refunds will be provided for change of mind.
Duplicate or incorrect purchases: If a certificate is issued incorrectly due to a technical error on our part, we will reissue the correct certificate free of charge or provide a full refund within 14 days of the purchase date.
Fraudulent transactions: If you believe your payment was used fraudulently, contact us immediately at admin@neogh.org. We will investigate and cooperate with Flutterwave's dispute resolution process.

To request a refund, contact admin@neogh.org with your transaction reference number.

6. Intellectual Property

All content on NeoGH — including but not limited to quiz questions, module text, the Ghana National Youth Policy framework, design system, logos, graphics, and software — is owned by or licensed to NeoGH. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content without prior written permission.

Your quiz answers, mission progress, and user-generated content remain your property. By submitting them, you grant NeoGH a non-exclusive, royalty-free, worldwide licence to use, display, and analyse them for platform operation and improvement.

7. Copyright Infringement (DMCA Notice)

If you believe content on NeoGH infringes your copyright, please provide a notice to admin@neogh.org containing:

Identification of the copyrighted work claimed to be infringed
Identification of the infringing material and its location on the Platform
Your contact information (name, email, address)
A statement that you have a good-faith belief that the use is not authorised
A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorised to act on their behalf
Your physical or electronic signature

We will respond to valid DMCA notices and may remove or disable access to the allegedly infringing material.

8. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion. Grounds for termination include but are not limited to:

Breach of these Terms
Fraudulent or illegal activity
Harassment or abuse of other users
Attempted security breaches

You may delete your account at any time by contacting admin@neogh.org. Upon termination, your personal data will be handled as described in our Privacy Policy. XP, badges, and progress are non-transferable and have no monetary value.

9. Service Availability and Disclaimer

NeoGH is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure at all times. We reserve the right to perform maintenance, updates, or suspend access temporarily without liability.

We are not responsible for any loss of data, XP, progress, or leaderboard position resulting from technical issues, account termination, or platform changes.

10. Limitation of Liability

To the maximum extent permitted by law, NeoGH and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of data, loss of XP, loss of reputation, or interruption of service. Our total liability shall not exceed the amount you have paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold NeoGH harmless from any claims, losses, damages, or expenses (including legal fees) arising from your violation of these Terms, your misuse of the Platform, or your violation of any law or third-party right.

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms are governed by the laws of the Republic of Ghana, without regard to its conflict of law provisions.

12.2 Informal Resolution

Before filing any claim, you agree to attempt to resolve the dispute informally by contacting admin@neogh.org. We will respond within 14 days.

12.3 Arbitration

Any dispute arising from these Terms that cannot be resolved informally shall be settled by binding arbitration in Accra, Ghana, in accordance with the rules of the Ghana Arbitration Centre. The arbitration shall be conducted by a single arbitrator appointed by mutual agreement. The decision of the arbitrator shall be final and binding.

12.4 Class Action Waiver

All disputes shall be resolved on an individual basis. You waive any right to participate in a class action, consolidated action, or representative proceeding against NeoGH.

12.5 EU/UK Users

If you are a user based in the European Union or the United Kingdom, nothing in this section deprives you of the protection of mandatory consumer protection laws of your country of residence. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may update these Terms at any time. Material changes will be notified via email to registered users and by posting a notice on the Platform. Continued use after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Platform and delete your account.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NeoGH regarding your use of the Platform and supersede any prior agreements or understandings.
